    The Supreme Court today refused to entertain plea filed by an MBBS student against termination of his admission "without any notice or opportunity of hearing".

    A bench of Justices Rajesh Bindal and R Mahadevan heard the matter and dismissed the case as withdrawn, with liberty to approach the jurisdictional High Court.

    The petitioner approached the top Court seeking re-admission to the MBBS course for session 2024-2029. He further sought a declaration that termination of his admission without any notice or hearing was illegal.

    A direction was also sought to the respondents to frame and enforce uniform procedural safeguards in disciplinary matters in medical colleges to ensure fairness and transparency.

    During the hearing, when the bench questioned as to why the petitioner did not approach the High Court at the first instance, the petitioner's counsel informed that the top Court has issued notice on plea of another MBBS student who approached against vacation of interim protection granted in her plea challenging termination of admission. He further submitted that a transfer petition related to the issue is also pending and coming up on July 14.

    Perusing the records, the bench noted that the order referred to was interim in nature and not on merits. "We are not going to entertain a direct writ petition here", said Justice Bindal.

    At this stage, the petitioner's counsel sought liberty to withdraw and approach the High Court. The matter was accordingly disposed of.
