    The Supreme Court on Friday (September 26) issued notice to the Indian Institute of Technology (IIT), Kharagpur, on a petition filed by a student seeking transfer to IIT Delhi.

    The petitioner, a Scheduled Caste student who is in need of mental healthcare treatment, seeks transfer to IIT-Delhi so that he can stay with his parents and avail treatment at the All India Institute of Medical Sciences (AIIMS), Delhi. 

    A bench comprising Justice BV Nagarathna and Justice R Mahdevan issued notice to the IIT Delhi and AIIMS as well, seeking their responses.

    In the petition filed under Article 32 of the Constitution, the petitioner referred to the recent judgment in Sukdeb Saha Vs State of Andhra Pradesh which declared that "mental health is an integral component of the right to life under Article 21 of the Constitution of India" and issued a set of guidelines to Higher Educational Institutions to protect the mental health of students.

    The petitioner stated that he was undergoing depression and was suffering from borderline personality disorder, which required advanced treatment. Since Bachelor of Architecture- the course which the petitioner is studying in Kharagpur- is not available in IIT-Delhi, the petitioner sought accommodation in a suitable B.Tech course in IIT Delhi as per his JEE Advanced rank.

    The matter will be next considered on October 10, 2025.
