    A plea has been filed in the Supreme Court by a Muslim man seeking a declaration that he should be governed by the Indian Succession Act instead of the Shariat law of inheritance.

    The bench of CJI Sanjiv Khanna and Justice Sanjay Kumar was hearing the plea filed by the Petitioner-in-person Naushad KK.

    The Court noted that another similar matter titled Sufiya PM v Union of India was pending before the Court, where the petitioner, Safiya PM, who sought that Muslims who have renounced their faith must be governed by the Indian Succession Act, 1925 instead of the Muslim personal law in matters relating to succession and inheritance.

    Prashant Padmanabhan, who is the Advocate-on-Record in the other matter (Sufiya PM), informed the bench that the pending matter was different from the present one, as here the petitioner was a practising Muslim, whereas the petitioner in the other case had renounced her faith. Padmanabhan also told the bench that a Special Leave Petition filed by the Quran Sunnath Society in 2016, where Section 58 of the Indian Succession Act 1925 is under challenge, is also pending. Section 58 of the Indian Succession Act excludes Muslims from its application.

    In the Sufiya PM matter, the Union Government had told the Court in October 2024 that it was for the Parliament to decide whether to extend the Indian Succession Act to Muslims.
