The Supreme Court will hear tomorrow a writ petition filed by 6 members of a family against their deportation to Pakistan in the wake of the Pahalgam Terror Attack.
The matter was listed today before a bench of Justices Surya Kant and N Kotiswar Singh, but was not heard at the first call. Pursuant to a mentioning, Justice Kant told the petitioners' counsel to go through a Times of India report published today as it could help him. The report was regarding an order of the Jammu and Kashmir and Ladakh High Court in a similar case.
Considering the urgency highlighted, the bench agreed to hear the case tomorrow. As per contentions, the petitioners have valid Indian passports as well as Aadhaar cards.
Notably, the same bench today refused to entertain a public interest litigation seeking directions for constitution of a judicial commission to probe the Pahalgam Terror Attack. More about the same can be read here.
The present petition comes in the backdrop of escalating tensions between India and Pakistan following the attack that took place on April 22 in Baisaran Valley, Pahalgam (Jammu and Kashmir), where terrorists opened fire on tourists and left 26 people dead.
After the attack, the Union government issued a slew of directions, including that all Pakistani nationals in the country on short-term visas shall leave by April 27 or face action. The same led many Pakistani nationals to cross borders within the stipulated timelines, while others left behind are facing deportation.
The petition is filed through AoR Dr Nanda Kishore.
