Allahabad High Court Tells Finance Ministry To 'Consider Training' DRT Officer Who Passed Similar Orders Without Application Of Mind

Noting similar orders being passed in cases by the Debt Recovery Tribunal, Lucknow without any application of mind, the Allahabad High Court observed that the Ministry of Finance must consider imparting training to the officers so that DRT can function smoothly.
Petitioners approached the High Court against the order of the DRT rejecting their application for interim relief. Though an appeal was maintainable against the order, it was argued that though reasons were given in support of grant of interim relief, they were recorded incorrectly and an abrupt order was passed rejecting petitioners' application.
Though the respondent tried to justify the order, the counsel admitted that the order was not well reasoned.
The Court observed that the lack of reasons in orders show the lack of training of the members of DRT. Quashing the order, it held that the order impugned showed non-application of mind.
Justice Pankaj Bhatia observed
“This court is noticing, similar orders passed by the DRT Lucknow in various matters, as such, let a copy of this order be sent to the Ministry of Finance, to consider imparting training to the officer concerned so that the functioning of the DRT for which it was established can go on smoothly.”
Accordingly, the Court directed that the matter be remanded back to DRT Lucknow for passing fresh orders after considering the pleadings by both sides.
