Delhi High Court Quashes Sexual Harassment Case After Accused Undertake To Do Community Service At Jama Masjid
The Delhi High Court has quashed a sexual harassment case following settlement and an undertaking by the two accused to do two months of community service at city's Jama Masjid.
Justice Anish Dayal noted that the parties entered into a settlement and that the chances of conviction of the two accused were remote and bleak.
The Court said that there was no use continuing with proceedings of the FIR as it would be a misuse of the judicial process and an unnecessary burden on the State exchequer.
Justice Dayal quashed the FIR registered by a woman in 2019 against the two men for the offences under Section 354 (assault on woman), 354A (sexual harassment), 354B (assault or using criminal force against woman with the intention to disrobe), 506 (criminal intimidation) and 509 (insulting modesty of woman) of Indian Penal Code, 1860.
The complainant woman said that she did not have any objection to the quashing of the case against the accused who were her relatives.
She said that senior family members had passed away and that the issue between them arose out of a domestic dispute which had been resolved.
The two accused, while seeking quashing of the FIR, undertook that they shall not indulge in such activities in future which may give rise to any occasion for further infraction.
They also undertook to deposit Rs. 5000 each before the Delhi Police Welfare Fund and to also do community service at Jama Masjid for four days in a month, for at least the next two months, for four hours each.
Noting their undertaking, the Court ordered:
“Accordingly, the petition is allowed. Consequently, FIR No. 202/2019….and proceedings emanating therefrom, are quashed qua the petitioner(s). Parties shall abide by the terms of settlement.”
