The Uttarakhand High Court on Thursday directed the unsealing of 4 madrasas, 1 located in Dehradun and 3 in Haridwar, which are among more than 135 madrasas sealed by the State Government in March this year.
The government's action was based on the allegation that they were running 'illegally', purportedly without affiliation and fulfilling norms of the madrasa board.
A bench of Justice Ravindra Maithani passed the orders of unsealing of Madras, subject to the condition that the Madrasas submit an undertaking not to operate any madrasa or school therein without due recognition from the State Government.
The petitioners had approached the Court contending that they were not running any madrasa, yet on March 29, 2025, the concerned authorities had sealed the premises without affording them an opportunity of hearing, in violation of the principles of natural justice.
By means of the interim relief application, the petitioners sought directions that the premises may be de-sealed till the disposal of the writ petition.
It was further pointed out that in a similar case (WPMS No. 835 of 2025), the Court had granted interim relief by ordering the unsealing of the premises.
Noting that this fact was also admitted by the State Counsel, the bench granted interim relief to the petitioners, subject to the condition that they shall not run any Madrasa or school without due recognition by the State Government under the Rules and Regulations.
