Supreme Court Stays Trial Against SP Leader Azam Khan & Son In Fake PAN, Forgery Cases Of 2019

The Supreme Court today(July 29) issued notice to the Uttar Pradesh Government in two Special Leave Petitions filed by Samajwadi Party (SP) leader Mohd Azam Khan and his son Abdullah Azam Khan against two different orders of the Allahabad High Court refusing to quash two 2019 case, wherein the allegations are that he forged documents for obtaining Passport and Pan Card, respectively.
A bench comprising Justice MM Sundresh and Justice NK Singh also granted stay in both orders.
In the first case, the FIR was registered in 2019 on allegations that he conspired with his father Mohd Azam Khan to forge documents and obtained fake Pan Card to file nomiantion for election of M.L.A as candidate of Samajwadi Party. In the forged Pan Card his date of birth was March 19, 1990 whereas in the earlier issued pan card, his date of birth is January 1, 1993 based on his high school certificate.
When the plea for quashing was made before the Allahabad High Court, Abdullah Azam Khan took the plea that the trial can't go on as it would amount to double jeopardy since he has already been convicted for obtaining fake birth certificate. However, the High Court through an order dated July 23 refused, observing that both were different and distinctive offences. It ordered the Rampur MP/MLA Court to proceed with the trial.
In another case, Abdullah Azam Khan is facing trial for forging documents to obtain passport with date of birth as September 30, 1990 whereas his school certificates mention date of birth as January 1, 1993. In this case as well, a plea of double jeopardy was taken as he claimed he has been convicted already for the same offence. However, the High Court refused this plea as well on July 23.
